Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Just Ice Tea and Eat the Change website and any related subdomains (collectively, the “Site”), operated by Eat the Change, Inc. (“Just Ice Tea,” “Eat the Change,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you should not use the Site.
Description of the Site
The Site provides information about our products, allows users to purchase select products, participate in promotions or loyalty programs, subscribe to marketing communications, and interact with our brand.
All content available on the Site, including text, graphics, logos, images, videos, and software (collectively, “Content”), is owned by or licensed to us and is protected by intellectual property laws.
We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice.
Eligibility
You represent that you are at least 18 years old or the age of majority in your jurisdiction and legally capable of entering into a binding agreement.
You may not use the Site if you are prohibited from doing so under applicable law.
Purchases and Orders
All purchases made through the Site are subject to product availability. We reserve the right to limit quantities, refuse or cancel orders, or correct pricing errors at any time, including after an order has been submitted.
If we cancel an order after payment has been processed, we will issue a refund to your original payment method.
You agree to provide accurate and complete billing and shipping information and to make purchases in good faith.
Additional policies related to shipping, returns, or exchanges may apply and are incorporated into these Terms by reference.
Product Guarantee
Our products undergo thorough quality assurance procedures to ensure they live up to our high standards. However, if you receive your product and it is defective, damaged or does not meet your expectations please snap a photo and send it to ssb@eatthechange.com so that we can assess the situation and prevent it from happening again. If you purchased your product directly from Just Ice Tea or one of our authorized partners, we will happily replace your product or issue you a refund. Unfortunately, we cannot warrant products for defects that have been handled by distributors outside of our carefully selected network of partners.
Accounts
Certain features of the Site may require you to create an account.
You agree to provide accurate information and maintain the confidentiality of your account credentials. You are responsible for all activities that occur under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
SMS and Email Communications
By signing up for email or SMS communications, you consent to receive marketing and transactional messages from us. Standard messaging and data rates may apply.
You may opt out of marketing communications at any time by following the unsubscribe instructions in emails or replying STOP to SMS messages.
Consent to receive marketing messages is not a condition of purchase.
User-Submitted Content
If you submit reviews, photos, social media content, feedback, or other materials (“User Content”), you retain ownership of your content.
However, by submitting User Content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and display such content for marketing, promotional, and business purposes.
You represent that you have the right to submit such content and that it does not infringe on the rights of any third party.
We reserve the right to remove any User Content that violates these Terms.
Prohibited Conduct
You agree not to:
- Use the Site for unlawful purposes
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Post harmful, defamatory, abusive, or misleading content
- Interfere with the security or operation of the Site
- Attempt unauthorized access to our systems
We reserve the right to restrict access to the Site if you violate these Terms.
Intellectual Property
All trademarks, logos, product names, designs, and Content on the Site are owned by Eat the Change, Inc. or its licensors.
You may not copy, reproduce, distribute, modify, or create derivative works without prior written consent.
Third-Party Services and Links
The Site may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of third parties.
Your use of third-party services is at your own risk and subject to their terms.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
YOUR USE OF THE SITE IS AT YOUR OWN RISK.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EAT THE CHANGE, INC., ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR PRODUCTS.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Eat the Change, Inc. and its affiliates from any claims, damages, liabilities, and expenses arising out of your violation of these Terms or misuse of the Site.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Any disputes not subject to arbitration shall be brought in the state or federal courts located in Maryland, and you consent to jurisdiction in those courts.
Changes to These Terms
We may modify these Terms at any time. Changes will become effective when posted. Continued use of the Site constitutes acceptance of the updated Terms.
